There are two ways a marriage is dissolved by a court in India, and almost everything about the process — how long it takes, what it costs, how difficult it becomes — follows from which one you are in.

Mutual consent

Where both spouses agree that the marriage should end and agree on the terms — custody, maintenance, return of belongings, anything owed — the petition is filed jointly. Under Section 13B of the Hindu Marriage Act, 1955, and the corresponding provisions of the other personal laws and the Special Marriage Act, 1954, the court records a first motion, and a second motion follows after a statutory interval of six months.

That six-month period can be waived. In Amardeep Singh v. Harveen Kaur (2017) the Supreme Court held the interval to be directory rather than mandatory, so a court may shorten it where the parties have already been separated for the statutory period and reconciliation is not a live possibility. Whether to ask for a waiver is a decision taken on the facts of the particular matter.

Contested divorce

Where one spouse does not agree, or the parties cannot settle terms, the petition is contested and must be proved on a ground recognised by the applicable personal law — cruelty, desertion, adultery, conversion, mental disorder, or the other grounds set out in the statute. Evidence is led, witnesses are examined, and the matter runs on a hearing schedule rather than a fixed timetable.

A contested divorce commonly runs alongside other proceedings: maintenance, custody, a domestic-violence application, sometimes a criminal complaint. Those are separate matters in separate forums, and part of the work is keeping them coordinated rather than letting each drift on its own.

Which court

Matrimonial proceedings in Kolkata are ordinarily filed before the Family Court or the District Judge, depending on where the parties last resided together and where the respondent resides. Getting the forum right at the outset avoids a return of the petition months later.

  • Marriage certificate, nikahnama or proof of marriage, and wedding photographs if the marriage is disputed.

Divorce in Kolkata — your questions

The statutory interval between the first and second motion is six months, and the whole process commonly runs somewhere between six and eighteen months depending on the court's board. Where the parties have already lived apart for the statutory period, an application can be made to waive the six-month interval, following Amardeep Singh v. Harveen Kaur (2017). No advocate can promise a date — the court's calendar decides.

Considerably longer, and it is not possible to state a figure honestly, because it depends on the grounds, the evidence, whether interim applications are filed, and the court's schedule. What can be said at the first consultation is what stages the matter has to pass through.

Where the terms are genuinely agreed, a joint petition can be filed. Where either spouse has any doubt about the terms, independent advice is the safer course, and this chamber will say so rather than act for both.

In a mutual petition they are settled as part of the agreed terms and recorded by the court. In a contested matter they are usually dealt with by separate applications, often decided long before the divorce itself. Interim maintenance under Section 24 of the Hindu Marriage Act, or under Section 144 of the BNSS (formerly Section 125 CrPC), can be sought while the main matter is pending.
